DLD Technologies Corporation dba Deledao (“Deledao”, “Company”, “we”, or “us”) is committed to protecting your privacy. This Privacy Policy (“Policy”) describes how we collect, store, use and disclose information that we obtain about users of our software (including mobile applications) and related services (“Services”), and visitors to our website (“Site”). For the purposes of this Privacy Policy, “you” and “your” refers to a school or school district that uses our Services, or an individual user of our Services, or visitor to our Site.

We use your data to provide and improve the Services. By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy.

 

Information We Collect about You

Information You Provide​

We collect information about you in various ways when you use our Services. When you agree to our Privacy Policy, you consent to our collection of this information and permit us to use it for the purposes described in this Privacy Policy.

Such information may include, but is not limited to, a range of data and information that you may use to identify you, your child, your name and email address, and your username and password that you use to register or log in to our Services.

In addition, if you contact us for customer support or provide us with feedback, we will collect the data included in the communication. 

 

Any personal information we collect about a “student” or “students” including a “child” or “children” under 13 years old will be collected and treated in accordance with applicable laws, including the Children’s Online Privacy Protection Act (“COPPA”). Schools or parents who use our Services has given consent for us to collect data from their children or students.

Information We Collect Automatically​

We may automatically collect information about your use of the Site and/or Services through cookies and other technologies.

For example, when you use our Site and/or Services, we may collect some specific device information, such as: device operating system, Internet Protocol (“IP”) address, access times, browser language, and device identifier numbers. 

The Services may collect and store your Google user data, like email address, username and org unit, which are needed by your school admin to use the Services.

We also collect information about your usage and activity throughout our Services. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time.

We and our third party service providers may use cookies and similar tracking technologies to track the activity on our Site and/or Services and hold certain information to improve and analyze our Site and/or Services.

 

​A cookie is a small piece of data that a website stores on your device when you visit. It typically contains information about the website itself, a unique identifier that allows the site to recognize your web browser when you return, additional data that serves the cookie’s purpose, and the lifespan of the cookie itself.

 

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Services, such as accessing your account.

 

We may also use third party analytics, such as Google Analytics, to analyze usage of our Site and/or Services. The purpose is to improve our Site and/or Services.

 

Wellness Data Processing

 

Our Services can recognize toxic language to detect potential cyberbullying and self-harm behavior. Upon detection of such behavior, our Services send an alert to the designated person(s) that registered for this service. This service is triggered by the AI (Artificial Intelligence) system automatically. Our Services assure that only the designated person(s) receives the alert. The recipient of such an alert is legally responsible for reviewing the contents included in the warning and is responsible for taking appropriate action.

Purposes for Using Your Data

We use personal data collected through our Site and Services for purposes described in this Policy or disclosed to you on our Site, or in connection with our Services. We only collect data for these limited purposes and personal information will not be further processed in a manner that is incompatible with these purposes.

 

​We may use your information: 

  • For analytics, market research, or business development, including to operate, maintain and improve our Services and Site; 

  • To tailor the content and information that we may send or display to you while using Services; 

  • To respond to your comments and questions and provide customer support; 

  • To send you related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;

  • To communicate with you about new promotions, rewards, upcoming events, and other news about Services offered by Company and our selected partners. We do not use personal information to market to students or children;

  • To help understand your needs and provide you with better service;

  • To analyze how you interact with our Services; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes;

  • To consider your employment application;

  • For internal record keeping and administrative purposes;

  • To comply with our legal obligations; 

  • For security and fraud prevention, and to ensure that our sites and apps are safe, secure, and used in line with our terms of use.

From your personal data, we may also create aggregate, anonymous, or de-identified data records so that we may better understand usage of our Services and improve our offering. Company reserves the right to use and disclose aggregate, anonymous, or de-identified data records to third parties at its discretion.

We do not use personal data in the following ways when acting in the role of a school service provider of education products:​​

  • We do not sell students’ personally identifiable data.

  • We do not target students or children in our advertising or marketing promotions.

  • We do not use students’ personal information collected from our education products to sell behavioral targeted advertising to students or parents. 

  • We do not collect a student’s personal information for building individual student profiles for commercial purposes not related to the provision of the Services.

 
Payment Information

If you sign up for our Paid Services, or make other purchases through the Services, your credit card or debit card information (such as card type and expiration date) and other financial data that we need to process your payment may be collected and stored by the payment processors with which we work.

We also collect certain details of your transaction history which are necessary to provide the Paid Services. In addition, the payment processors generally provide us with information related to you, such as a unique token that enables you to make additional purchases using the information they’ve stored, including recurring payments if you authorize automatic renewals, and your card’s type, expiration date, and certain digits of your card number.

 

 

Data Controller vs Data Processor

 

For the purposes of GDPR and other similar regulations, our school customers are the data controllers of the student data; we are data processors of that student data and we are subject to the policies of the data controllers. For other personal data that we collect, we are the data controllers.

 
How We Share Your Information

We do not share your personal data with third parties other than as follows: ​​

  1. With your consent; 

  2. With third party vendors, consultants and other service providers who work for us and need access to your information to do that work, and are required by contract not to use your personal data other than to provide the services requested by the Company; 

    1. If we share personal data with third party service providers, we encrypt the data that is shared.

    2. If we share student data with third parties, they are required to treat that data in a manner consistent with our privacy policy;

    3. Examples of third party service providers may include but are not limited to: payment processing, data analysis, email delivery, hosting and server providers, IT service providers, data storage, error loggers, maintenance or problem solving providers, customer service and marketing providers. We may allow selected third parties to use tracking technology on the Website, which will enable them to collect data on our behalf about how you interact with our Website over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity.

  3. To (i) comply with laws or to respond to lawful requests and legal process, (ii) to protect the rights and property of the Company, our agents, customers, members, and others including to enforce our agreements, policies and terms of use or (iii) in an emergency to protect the personal safety of the Company, its customers, or any person; 

  4. In connection with or during negotiation of any merger, financing, acquisition, or dissolution, transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets to another company; or in the event of insolvency, bankruptcy, or receivership, your information may also be transferred as a business asset;

    1. ​In such an event, we will work to ensure that the successor entity has a commitment to student privacy or allow you to opt-out of this information transfer.

 

We may share aggregated, anonymized, or de-identified information in our sole discretion. Aggregated, anonymous, or de-identified data is not subject to the same restrictions that applies to personal data.

We do not sell your personal data.

 

Your Right to Withdraw Consent

You may withdraw your consent to our processing of your personal information at any time. However, withdrawing consent may result in your inability to continue using some or all of the Services.

 

Your Choices and Rights Regarding Your Personal Information

Your choice: By continuing to use our Services and/or providing personal information to us, you understand we will collect, hold, use, and disclose your personal information in accordance with this Privacy Policy. 

Modifying personal information: You may modify certain personal information that you have submitted by logging in to your account and updating your profile information including your username and password. Please note that we may retain certain information about you as required by law or as permitted by law for legitimate business purposes (e.g., in accordance with our record retention policies).

Unsubscribe: You may opt out of receiving promotional emails from us by following the instructions in those emails. If you opt out of receiving promotional emails, we may still send you non-promotional emails, such as emails about your accounts or our ongoing business relations.

 

Notification of data breaches: We have a breach response plan in place that includes notification of affected parties and steps for remedying the situation. We will comply with relevant laws applicable to us in respect of any data breach.

Residents of the state of California, EEA (European Economic Area), or Switzerland: Residents of these listed geographical regions have the right to request what categories of personal data is collected, why it was collected, access to that personal data, what it’s used for, who it’s shared with, and for personal data to be corrected, deleted, or transferred. We will not discriminate against users for exercising these rights. However, our Services and/or Site may depend on our ability to process personal data so if you exercise certain rights, we may not be able to provide our Services and/or Site to you. If you are a user of our products for schools, please directly submit your request to the data controller, the school or district, since in this case we are the data processor. If you are a user of our products for parents, please use the contact information in this privacy policy to submit your request. We will require verification of your identity before we can fulfill your request.

Security of Your Personal Information

The security of your personal information is important to us. Your data is encrypted and housed in U.S. data centers.

 

We use a variety of industry-standard security technologies and procedures to help protect your personal data from unauthorized access, use, or disclosure. Some examples of these safeguards are listed below: 

 

  • Administrative: Limiting personal information access to necessary personnel, etc. 

  • Technical: SSL, encryption at rest, firewalls, etc. 

  • Physical: Physical access controls, etc. 

While Company uses reasonable efforts to protect your personal data, no security measure is completely secure, and we cannot guarantee the security of your information. 

You are responsible for selecting any password and its overall security strength, ensuring the security of your own information within the bounds of our services. For example, ensuring any passwords associated with accessing your personal information and accounts are secure and confidential.

 

Retention of Your Personal Data

We keep your personal data to enable your continued use of the Services for as long as it is required in order to fulfill the relevant purposes described in this Privacy Policy, as may be required by law such as for tax and accounting purposes. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. Once students’ personal information is no longer required as per the previously stated reasons, it will be deleted.

 

International Transfers of Personal Information

Deledao is based in the United States and the personal information we collect is stored and/or processed in United States. For non-U.S. residents, your continued use of our Services or Site constitutes your consent to this data transfer.

 

If we transfer your data to the United States, (i) we will perform those transfers in accordance with the requirements of applicable law; and (ii) we will protect the transferred personal information in accordance with this Privacy Policy.

Use of Third-Party Services

Our software may also use third-party services to provide functions you ask for. For instance, the YouTube API service is used to obtain and display the metadata of YouTube videos, such as categories and channel names. None of your personal information is shared with such third parties. Below is a list of the privacy policies of such third parties. 

Changes to This Privacy Policy

This Policy is effective as of the Last Revised set forth above. We may change this Policy from time to time, so please be sure to check back periodically. Any changes to this Policy will be posted on our Site. If you do not agree to this Policy as modified, then you must discontinue your use of the Services. Your continued use of the Services after the effective date of such changes will signify your continued agreement to this Policy and any changes made.
